Please Save the Tree House… Please STOP the destruction of a childhood dream, work of art and creativity
Please help stop the destruction of the only beach tree house on Anna Maria Island. Please stop the conflict, stop wasting time and resources over a safe and harmless double deck in a tree. We built it with love. We cannot voluntarily remove it, nor able to pay more than $500 per day to defend it year after year.
As a brief history, April 2011, we received approval from the city building department to build the tree house as “no permit required”. November 2011, as we almost completed our double deck tree house, we received a notice from Florida Department of Environmental Protection. We are informed that as we are on the beach, under its jurisdiction, we must get an FDEP permit or remove the tree house. Legal determined that the tree house is exempted. FDEP insisted on an after the fact permit. So we complied and submitted study and documents to the state agency to obtain exemption and/or an after the fact permit. FDEP requires a letter from the city concerning local setbacks and zoning codes. We requested a meeting with the new city building official to get such a letter, but in response, we get a city’s notice of violation ordering the destruction of the tree house. This notice is 2 years after the first approval by the city. It is also over one year after FDEP has already evaluated the tree house and allows us to proceed with an after the fact permit.
