In mid-October, we took a leap of faith. We filed our legal petition, called a Writ of Certiorari, with the higher court, the Second District Court of Appeal, where our case will reviewed by a panel of multiple experienced judges. The higher court does not automatically accept to review every petition filed, so we were highly anxious.
On November 3rd, the District Court of Appeal ordered the city to respond to the issues raised in the writ of certiorari by November 24th. Following the city’s response, we will have 20 days to reply. So we now have hope and a chance to be heard by the higher court.
As of last week, the city has submitted a Notice requesting more time, delaying the response date to December 22nd. We agree and ask that since it will be near year-end holidays and with previously scheduled vacation, we also need the same time extension beyond the 20 days given to reply. The city’s attorney agrees. Sounds like a simple agreement, but then we had some legal issues with the actual filing of the time extension. So what I understood is one notice to be filed by the city’s attorney to the court for extension covering both parties, now becomes two motions and/or notices pending court approval.
It just seems like Murphy’s law is at work since the day we got the first notice of violation, citing us for building the tree hut on dead tree trunks, for raking our beach with a hand rake for cigarette butts, and on and on. One thing for sure we hope we will not lose what we love and work hard for. We continue to pray and believe that in the end the right thing will be done , our tree hut will be saved, and life return to harmony and happiness.
