As of mid-week last week, we received more than 500 signatures and great comments from our petition both on the web and in persons. The petition continues. Since the not so good report by the building official to the mayor and commissioners, local ABC 7 MySunCoast, came paid a visit and did a story “Fate of beach tree house up in the air”
We received an updated survey of the tree house last week for our attorney to request an official interpretation of the city land development code as the notice of violation claimed that the tree and tree house violates the local setbacks, meaning it is not far enough from the side and the beach erosion control line, even though our property extends beyond that line to the water line. According to city code and the survey, the tree and the tree house is within the allowed use and met city code requirements as an elevated enclosed deck or cabana. I am posting the letters from our attorney here for anyone who is interested.
